MANILA, Philippines -- The Sandiganbayan First Division on Wednesday allowed former President now Pampanga Rep. Gloria Macapagal-Arroyo to file a demurrer to evidence, a move that could lead to the outright dismissal of her plunder case without rebutting the prosecution’s evidence against her.
If the soon to be filed petition for demurrer to evidence is granted by the anti-graft division, Mrs. Arroyo can regain her freedom if the prosecution's evidence is weak.
The former President was charged for plunder on allegations that she conspired with former top officials of the Philippine Charity Sweepstakes Office (PCSO) in the alleged fraudulent conversion of the state lottery firm’s P366-million corporate funds into confidential intelligence funds and releasing the sum for dubious expenses.
Counsel Jose Flaminiano, lawyer for Mrs. Arroyo who is currently detained at the Veterans Memorial Medical Center (VMMC), said the development made them to believe that the evidence against their client is not that strong.
"In our opinion, the court sees no strong evidence had been presented by the prosecution panel that is why we will file demurrer," said Flaminiano after the hearing.
