The intent is laudable. Now, as usual, comes the hard part: effectively enforcing a new law Republic Act 10175, or the Cybercrime Prevention Act of 2012. The measure enhances or expands existing laws against crimes committed using the Internet, including those against child pornography, human trafficking and voyeurism.
RA 10175 criminalizes a wide range of offenses committed through information and communication technology. Apart from computer-related forgery, fraud and identity theft, the offenses include cyber squatting, illegal access to computer data, illegal data interception, data and system interference, and activities that violate the confidentiality, integrity and availability of computer data. There are also provisions to strengthen existing laws against cyber sex and child pornography.
There are certain gray areas in RA 10175 that may need amendment or may reach the courts. One is the provision against libel through the Internet. Whether or not this covers posts on Twitter and Facebook is unclear. Another provision bans unsolicited commercial communications. While most people will welcome this, is the government capable of enforcing it?
